RESOLUTION THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO.2021-051 <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL AUTHORIZING <br />THE CITY MANAGER TO NEGOTIATE AND EXECUTE AMENDMENT NO.2 AND <br />SUBSEQUENT AMENDMENTS WITH INDIVIDUAL AND CUMULATIVE COSTS <br />AND EXPENSES OF LESS THAN $50,000 TO THE 1995 AGREEMENT FOR <br />MAINTENANCE OF STATE HIGHWAYS IN THE CITY OF SAN LEANDRO <br />BETWEEN THE STATE OF CALIFORNIA AND THE CITY OF SAN LEANDRO (THE <br />PURPOSE OF THE AMENDMENT IS TO PROVIDE SEWER MAINTENANCE <br />ACCESS THROUGH STATE OF CALIFORNIA RIGHT-OF-WAY WITH GATES AND <br />PATHS TO BE MAINTAINED BY THE CITY) <br />WHEREAS, Amendment No. 2 to the 1995 Agreement for Maintenance of State <br />Highways in the City of San Leandro between the City of San Leandro and State of California, a <br />copy of which is attached, is presented to this City Council; and <br />WHEREAS, the City Council is familiar with the contents thereof; and <br />WHEREAS, the City Manager recommends approval of said agreement. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />1. That said agreements substantially in the form presented are hereby approved and <br />execution by the City Manager, after approval as to form by the City Attorney, is hereby <br />authorized; and <br />2. That the City Manager is authorized to make revisions to said amendments, subject to <br />the approval as to form by the City Attorney; and <br />3. That the City Manager is authorized to negotiate and execute subsequent amendments <br />with individual and cumulative costs and expenses of less than $50,000, subject to the approval as <br />to form by the City Attorney; and <br />4.
