Amendment No. 2 to Consulting Services Agreement between City of San Leandro and Glass Architects 1/29/21 for the Farrelly Pool Replacement Page 1 of 3 AMENDMENT NO. 2 TO CONSULTING SERVICES AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND GLASS ARCHITECTS FOR FARRELLY POOL REPLACEMENT This Amendment No.2 (“Amendment”) is made by and between the City of San Leandro (“City”) and GLASS ARCHITECTS (“Consultant”) (together sometimes referred to as the “Parties”) as of _____________, 2021, and amends that certain Consulting Services Agreement (“Agreement”), dated May 30, 2018, as amended by Amendment 1 dated May 7, 2019 between the Parties. WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has provided certain consulting services to City with regard to the Farrelly Pool Replacement, and WHEREAS, the Parties desire to amend the Agreement to provide additional construction administration and design services. NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby acknowledged, the Parties hereby agree to amend the Agreement as follows: 1. Section 1.1 of the Agreement entitled “Term of Services” is hereby amended to extend the term from December 31, 2020, to December 31, 2021; and 2. Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a sum not to exceed FOUR HUNDRED NINETY SIX THOUSAND TWO HUNDRED SIXTY SEVEN DOLLARS ($496,267); and 3. Exhibit A of the Agreement entitled “Scope of Services” is hereby amended to add the following: Additional Services for Amendment 2: The following additional consulting services were required after the project documents were issued for competitive bidding: 1. Complete permit approval process to address additional plan check comments from the City of San Leandro, Alameda County Health Departments, and the Department of State Architect (DSA). In addition, follow new DSA all-electronic format plan review process for approval of the school perimeter fence and ball wall. Revise construction documents to incorporate plan check revisions. 2. Design field revisions to the project scope made at the request of the City to add a pedestrian entry gate, accommodate card key access, coordination with the PG&E service drawings, and a revised water heater configuration. 3. Provide additional construction administration services over an extended project duration of construction which is four months longer than originally budgeted.
