movement of land or earth, including, but not limited to, sinking or settling of land, earth <br />movement, earth expansion and/or contraction, landslide, slipping, falling away, caving <br />in, eroding, earth sinking, and earth rising or shifting or tilting. <br />Fungal Pathogens Sublimit/Aggregate Limit <br />A sublimit applies to any loss, cost or expense directly or indirectly arising out of or related <br />to exposure to "fungal pathogens," whether or not there is another cause of loss that may <br />have contributed concurrently or in any sequence to the loss. The sublimit will be <br />$10,000,000 per occurrence, subject also to a $5,000,000 annual aggregate collectively in <br />Pool D only, for all covered parties. The designated general aggregate limit of $5,000,000 <br />is the most the Authority will pay from Pool D because of such claims for all covered <br />parties, combined, in any program year. <br />"Fungal pathogens" as used herein, shall mean any fungus or mycota or any byproduct or <br />type of infestation produced by such fungus or mycota, including, but not limited to, <br />mold, mildew, mycotoxins, spores, bacterial pathogens, or any biogenic aerosols. <br />Sexual Abuse — Daycare Operations Sublimit/A gregate Limit <br />A sublimit applies to "sexual abuse" arising out of daycare operations. The sublimit will <br />be $10,000,000 per occurrence, subject also to a $5,000,000 annual aggregate collectively <br />in Pool D only, for all covered parties. The designated general aggregate limit of <br />$5,000,000 is the most the Authority will pay from Pool D because of such claims for all <br />covered parties, combined, in any program year. All claims based on or arising out of <br />"sexual abuse" as respects daycare operations by the covered party's employee and/or <br />volunteer, or more than one of the covered party's employees and/or volunteers acting <br />in concert, will be considered as arising out of one occurrence regardless of: <br />(1) the number of persons sexually abused; <br />(2) the number of locations where the sexual abuse occurred; <br />(3) the number of acts of sexual abuse; or <br />(4) the period of time over which the sexual abuse took place. <br />An occurrence which extends to a duration of more than one coverage period shall be <br />treated as a single occurrence arising during the first coverage period when the <br />occurrence began. <br />As used herein, "sexual abuse" means any actual or alleged criminal sexual conduct of a <br />person or persons acting in concert, which causes physical and/or mental injuries.
