Claims arising out of the private use of a firing range owned, operated or maintained <br />by a covered party where such private use is sanctioned by the covered party, <br />except where such use is by a covered individual as defined in definition (8) (d). <br />This exclusion does not apply to such private use where all of the following <br />conditions are met: <br />(a) A qualified range master is present at all times while the firing range is being <br />utilized; <br />(b) The firing range is only provided for the additional use of law enforcement <br />divisions of other public agencies, and police academies, herein defined as <br />California P.O.S.T. (Peace Officers Standards & Training) Certified Basic <br />Academies; <br />(c) Any agency using the firing range has provided an indemnification agreement <br />which assumes full responsibility by the user agency for all liability arising out <br />of their activities; and <br />(d) The user agency has provided liability coverage in an amount of not less than. <br />$1,000,000 and has also provided a certificate of coverage which names the <br />CJPRMA member as an additional covered party. <br />19) Hospitals <br />Claims arising out of ownership, maintenance, management, supervision or the <br />condition of any hospital. <br />20) Intentional Conduct <br />Claims for injury or damages caused by intentional or criminal conduct done by the <br />covered party with willful and conscious disregard of the rights or safety of others, <br />or with malice. However, where the covered party did not authorize, ratify, <br />participate in, consent to, or have knowledge of such conduct by its past or present <br />employee, elected or appointed official, or volunteer, and the claim against the <br />covered party is based solely on its vicarious liability arising from its relationship <br />with such employee, official or volunteer, this exclusion does not apply to said <br />covered party. <br />21) Jumping/Propelling Activities <br />Claims arising out of bungee jumping or propelling activities sponsored, controlled <br />or authorized by a covered party. <br />22) Land Use <br />Memorandum of Coverage <br />Effective: 0710112019 <br />20 <br />
