<br />Amendment No. 1 to 6/1/21 <br />Consulting Services Agreement between City of San Leandro and OIR Group Page 1 of 3 <br /> <br />AMENDMENT NO. 1 TO CONSULTING SERVICES AGREEMENT BETWEEN <br />THE CITY OF SAN LEANDRO AND <br />OIR GROUP <br />FOR <br />ADDITIONAL INTERNAL AFFAIRS INVESTIGATION SERVICES <br /> <br /> <br />This Amendment No. 1 (“Amendment”) is made by and between the City of San Leandro (“City”) <br />and OIR Group (“Consultant”) (together sometimes referred to as the “Parties”) as of June 1, 2021 and <br />amends that certain Consulting Services Agreement (“Agreement”) dated October 19, 2020, between the <br />Parties. <br /> <br />WHEREAS, City and Contractor have executed the Agreement, pursuant to which Consultant has <br />provided certain consulting services to City with regard to internal affairs investigation services; and <br /> <br />WHEREAS, the Parties desire to amend the Agreement to expand the scope of work to include an <br />additional internal affairs investigation. <br /> <br />NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby <br />acknowledged, the Parties hereby agree to amend the Agreement as follows: <br /> <br />1. Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a <br />sum not to exceed $95,000; and <br /> <br />2. Exhibit A, Sections 1. and 2. of the Agreement entitled “Scope of Services” is hereby amended <br />in its entirety to read as follows: <br /> <br />At the request of the City Manager, and for the Police Chief’s disposition, conduct an internal affairs <br />investigation of current San Leandro Police Department peace officers and staff who were involved in the <br />shooting incident that occurred April 18, 2020 at 15555 Hesperian Boulevard, San Leandro, CA 94579 <br />(Taylor OIS), and the shooting incident that occurred August 5, 2020 at or near Pearmain Street, Oakland, <br />CA 94603 (Bettencourt OIS). <br /> <br />Conduct a training review as an “alternative” to the Training Committee’s reviews of the April 18, 2020 and <br />August 5, 2020 incidents, as outlined in the San Leandro Police Department’s Training Committee Policy, <br />currently numbered as Section 204.6. The policy provides that the Training Committee should review <br />certain incidents to determine whether training would likely improve future outcomes or reduce or prevent <br />the recurrence of the undesirable issues related to the incident. The purpose of using this alternative <br />method is to expedite the review process in recognition of the need for an expeditious collection and <br />dissemination of learning points to the entire department. <br /> <br />The purpose of the Training Review is to evaluate a critical incident objectively and the actions of San <br />Leandro Police Department (SLPD) personnel, leading up to and during that critical incident, in order to <br />identify potential ways to make improvements in SLPD training, policy, equipment, and to make <br />recommendations to SLPD command staff.
