Amendment No. 1 to 6/1/21 Consulting Services Agreement between City of San Leandro and OIR Group Page 1 of 3 AMENDMENT NO. 1 TO CONSULTING SERVICES AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND OIR GROUP FOR ADDITIONAL INTERNAL AFFAIRS INVESTIGATION SERVICES This Amendment No. 1 (“Amendment”) is made by and between the City of San Leandro (“City”) and OIR Group (“Consultant”) (together sometimes referred to as the “Parties”) as of June 1, 2021 and amends that certain Consulting Services Agreement (“Agreement”) dated October 19, 2020, between the Parties. WHEREAS, City and Contractor have executed the Agreement, pursuant to which Consultant has provided certain consulting services to City with regard to internal affairs investigation services; and WHEREAS, the Parties desire to amend the Agreement to expand the scope of work to include an additional internal affairs investigation. NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby acknowledged, the Parties hereby agree to amend the Agreement as follows: 1. Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a sum not to exceed $95,000; and 2. Exhibit A, Sections 1. and 2. of the Agreement entitled “Scope of Services” is hereby amended in its entirety to read as follows: At the request of the City Manager, and for the Police Chief’s disposition, conduct an internal affairs investigation of current San Leandro Police Department peace officers and staff who were involved in the shooting incident that occurred April 18, 2020 at 15555 Hesperian Boulevard, San Leandro, CA 94579 (Taylor OIS), and the shooting incident that occurred August 5, 2020 at or near Pearmain Street, Oakland, CA 94603 (Bettencourt OIS). Conduct a training review as an “alternative” to the Training Committee’s reviews of the April 18, 2020 and August 5, 2020 incidents, as outlined in the San Leandro Police Department’s Training Committee Policy, currently numbered as Section 204.6. The policy provides that the Training Committee should review certain incidents to determine whether training would likely improve future outcomes or reduce or prevent the recurrence of the undesirable issues related to the incident. The purpose of using this alternative method is to expedite the review process in recognition of the need for an expeditious collection and dissemination of learning points to the entire department. The purpose of the Training Review is to evaluate a critical incident objectively and the actions of San Leandro Police Department (SLPD) personnel, leading up to and during that critical incident, in order to identify potential ways to make improvements in SLPD training, policy, equipment, and to make recommendations to SLPD command staff.
