Modification No. 2 to Loan Agreement between Dan & Gina Dillman and the City of San 05/28/2021 Leandro Page 2 of 3 adequacy of which is hereby acknowledged by the Parties, the Parties hereby agree as follows: Section 1. Recitals. The above recitals are true and the recitals, and defined terms set forth therein, are incorporated into this Modification by this reference. Section 2. Deferral of Payment. The payments due to Lender from Borrower on June 1, 2021 and December 1, 2021 pursuant to the Loan are deferred. Repayment shall begin on June 1, 2022, with monthly payments in an amount of one thousand seven hundred seventy-four dollars and ninety-six cents ($1,774.96) as reflected on the Amended Payment Schedule (Exhibit A), .The payments and interest accrued during the 2021 calendar year shall be paid in equal amounts over the life of the Loan. This Modification does not constitute a waiver or modification by Lender of its right to either require prompt payment when due of all other sums so secured, or to declare default for failure to so pay. Failure by Borrower to make the deferred payment by the specified date will lead to default. Upon the occurrence of a default, Lender shall have all remedies available to it under law or equity, including, but not limited to, those enumerated in the Agreement, and Lender may, at its election, without notice to or demand upon Borrower, except for notices or demands required by law or expressly required pursuant to the Loan Documents, exercise one or more of the remedies described in detail in the Agreement. Section 3. Effect on Agreement. Except as expressly provided for herein, all other provisions of the Agreement shall remain in full force and effect. The Parties have executed this Agreement as of the Effective Date. The persons whose signatures appear below certify that they are authorized to sign on behalf of the respective Party.
