<br /> <br />4810-5342-0509, v. 2 <br /> 7 <br /> <br />The Master Dispute Resolution Declaration recorded in the Official Records constitutes a part of this <br />Declaration and is incorporated herein by this reference as though set forth in full herein. A copy of the <br />Master Dispute Resolution Declaration can be obtained from the County Recorder of the County. <br />1.53 “Member” means every Person who holds a membership in the Association. <br />1.54 “Mortgage” means a recorded mortgage or deed of trust encumbering a Condominium in <br />the Community. <br />1.55 “Mortgagee” means a mortgagee under a Mortgage as well as a beneficiary under a deed <br />of trust. <br />1.56 “Module” means each module designated on the Condominium Plan(s). Each Module is <br />a three-dimensional portion of the Property and has been created pursuant to California Government Code <br />Section 66427. The lower and upper boundaries of each Module are set forth in the Condominium Plan. <br />The lateral boundaries of each Module are vertical planes which are also described and depicted in the <br />Condominium Plans. The Module includes all land and Improvements, whether now or hereafter, located <br />within its boundaries. <br />1.57 “Notice and Hearing” means the procedure that gives an Owner notice of an alleged <br />violation of the Governing Documents and the opportunity for a hearing before the Board. <br />1.58 “Occupant” means a Person that is entitled to occupy from time to time all or a portion of <br />a Unit, whether pursuant to a Lease, sublease, license or other similar agreement. <br />1.59 “Official Records” means the official public records of the County Recorder of Alameda <br />County. <br />1.60 “Owner” means the record owner, whether one or more Persons, including Declarant, of <br />any Condominium, excluding those having such interest merely as security for the performance of an <br />obligation, unless and until such Person acquires fee title thereto. <br />1.61 “Owner Maintenance Manual” means the manual prepared by Declarant setting forth the <br />standards and requirements for the maintenance by an Owner of the Unit and other Improvements. The <br />Owner Maintenance Manual may also be referred to as the “Homeowner Manual” or “Homeowner <br />Maintenance Manual” in other related documents. <br />1.62 “Person” means a natural person or any legal entity recognized under California law. <br />When the word “person” is not capitalized, the word refers only to natural persons. <br />1.63 “Phase” means that portion of the Property which is the subject of a separate Public <br />Report. <br />1.64 “Private Streets” means those streets, roads, drives and adjacent sidewalks within the <br />Association Property and related lighting, private drainage, pollution control devices, sewage and water <br />systems and other utility installations within such streets, roads, drives and sidewalks that are not <br />maintained by a public agency or franchised utility. <br />1.65 “Property” means all of the real property described on Exhibit “A” and any other real <br />property which may be annexed hereto. In the event of the de-annexation of any Property previously <br />subject to this Declaration, the term “Property” shall not include any such de-annexed land. <br />1.66 “Public Report” means the final subdivision public report issued by the DRE for a Phase <br />in the Community. <br />260
