<br /> <br />4810-5342-0509, v. 2 <br /> 13 <br /> <br />2.9.1 Generally. This Section does not apply to Improvements installed by <br />Declarant. <br />2.9.2 Outside Installations. The following items are prohibited unless approved by <br />the Board: (a) outside installations, including porch or deck covers, wiring, air conditioning equipment, <br />water softeners, other machines and other Improvements; (b) Improvements to deck railings; and (c) other <br />exterior additions or alterations to any Condominium or Exclusive Use Easement Area. Notwithstanding <br />the foregoing, religious items may be displayed on the entry door or door frame of an Owner’s Unit subject <br />to the restrictions set forth in California Civil Code Sections 1940.45 and 4706. <br />2.9.3 Inside Installations. Nothing may be done in any Condominium or in, on or to <br />the Association Property which may impair the structural integrity of any building in the Community or which <br />structurally alters any such building, except as otherwise expressly provided in this Declaration. <br />2.9.4 Decks. No Owner shall use any Exclusive Use Deck Area for storage <br />purposes, including, without limitation, the storage of bicycles. Unless installed by Declarant, all plants kept <br />in the Exclusive Use Deck Areas shall be kept in pots or planters which do not allow water to drain outside <br />of such pot or planter, and no vegetation shall be permitted to extend beyond the railings, walls and/or other <br />boundaries of the Exclusive Use Deck Areas, except as approved by the Board. The Board may require <br />approval of any potted plants. No Owner shall change or alter the surface of any Exclusive Use Deck Areas <br />without the consent of the Board. <br />2.9.5 Sports Apparatus. No basketball standards or fixed sports apparatus shall be <br />attached to any Condominium or placed anywhere within the Association Property. <br />2.9.6 Exterior Lighting. No additional exterior lighting may be installed by an <br />Owner. Any exterior electrical, gas or other artificial lighting installed on any Condominium Building shall <br />be positioned, screened, or otherwise directed or situated and of such controlled focus and intensity so as <br />not to unreasonably disturb the residents of any other Condominiums. Further rules regarding exterior <br />lighting may be promulgated by the Board. Some of the exterior lighting on Condominium Buildings <br />provides light to certain exterior portions of the Community and contains a photocell which will automatically <br />control their operation. Such exterior lighting shall not be manually turned off and the photocell shall not <br />be altered in any way by the Owners. <br />2.9.7 Outside Drying and Laundering. No exterior clothesline shall be erected or <br />maintained or hung on balconies or railings within the Community. There shall be no exterior drying or <br />laundering of clothes or any other items on any Exclusive Use Easement Area or Association Property. <br />2.9.8 Window Coverings. Temporary window coverings (“Temporary Window <br />Coverings”) in a design and color that does not conflict with the surrounding Improvements (but excluding <br />aluminum foil, newspapers, or any other contrasting material) shall be permitted for a maximum period of <br />ninety (90) days from the date that a Condominium is conveyed to an Owner by Declarant or such longer <br />period that may be authorized by the Board. Except as specifically provided above, no Temporary Window <br />Coverings shall be used to cover any door or window of any Unit. <br />2.9.9 Holiday Decorations. Outdoor holiday decorations, or indoor holiday <br />decorations that are visible from outside, shall be limited to a reasonable period of time prior to the date of <br />the holiday, as determined by the Association in the Rules, and shall be removed as and when required by <br />the Rules. <br />2.9.10 Fencing Material. The use or installation of barbed wire, razor wire, chicken <br />wire and chain-link fencing materials is prohibited within Community is prohibited. <br />2.9.11 Water Beds and Limitations on Size of Aquariums. No water beds shall be <br />permitted in any Condominium, and no Owner shall maintain in its Condominium any aquarium or other <br />266
