MTC/City of San Leandro <br />Master Funding Agreement for FY 2021-22 to FY 2030-31 <br />Page 34 <br /> <br /> <br />EXHIBIT B-4 <br />ADDITIONAL TERMS AND CONDITIONS <br />(PREVAILING WAGE RATES, APPRENTICESHIPS, AND PAYROLL RECORDS <br />NON FEDERALLY FUNDED AGREEMENTS) <br /> <br />AGENCY’s contractor(s) and all subcontractors shall comply with applicable sections of the <br />California Labor Code and regulations promulgated thereunder (including without limitation, Sections <br />1720 et seq. and Title 8 of the California Code of Regulations Sections 16000 et seq.) governing the <br />payment of prevailing wages, as determined by the Director of the California Department of Industrial <br />Relations, in regards to work performed and/or funded under this Agreement. In particular, AGENCY’s <br />attention is drawn to Labor Code Sections 1771 (payment of prevailing wage rate), 1775 (penalty for <br />non-payment), 1776 (payroll records), and 1777.5 (use of apprentices). AGENCY’s contractor(s) and <br />all subcontractors, to the extent the work of such contractor(s) and subcontractors under this Agreement <br />are subject to California Labor Code Section 1720 et seq., shall be registered with the Department of <br />Industrial Relations pursuant to Labor Code section 1725.5 and shall furnish electronic certified payroll <br />records directly to the Labor Commissioner through the internet portal of the Division of Labor <br />Standards Enforcement. Per Master Funding Agreement Article 12.0, Records and 13.0 Audits, MTC <br />reserves the right to request copies of the certified payroll records. <br /> <br />407
