CITY OF SAN LEANDRO <br />SUBDIVISION IMPROVEMENT AGREEMENT <br />(Public and Private Improvements) <br />THIS SUBDIVISION IMPROVEMENT AGREEMENT (the "Agreement"), executed in triplicate, <br />dated is made and entered into by and between the CITY OF SAN LEANDRO, <br />a municipal corporation of the State of California, hereinafter referred to as "City," and D.R. Horton Bay, Inc., <br />a Delaware Corporation, hereinafter referred to as "Subdivider,". <br />RECITALS <br />A. Subdivider has presented to City a certain final map of a proposed subdivision of land located <br />within the corporate limits of the City of San Leandro, common only known as 903 Manor Boulevard, San <br />Leandro, California. <br />B. The proposed subdivision of land is commonly known and described as, APN 080H-1541- <br />036 and bears the name Tract No. 8519. Said subdivision is hereinafter referred to as "the Subdivision." <br />C. A vesting tentative map for the Subdivision was approved by the City Council on September 9, <br />2020 by Resolution No. 2020-108 (the "Vesting Tentative Map").The final map for the Subdivision was filed <br />with the City Engineer for presentation to the City Council for its approval, which final map is referred to and <br />incorporated herein. <br />D. Subdivider has requested approval of the final map prior to the construction and completion of <br />improvements including, but not limited to, streets, highways or public ways, public utility facilities and other <br />facilities which are part of or appurtenant to the subdivision that are required by the Subdivision Map Act, the <br />San Leandro Municipal Code, the Vesting Tentative Map (and approvals given in connection therewith) and <br />final grading plan, if any, heretofore approved by City. Said improvements are hereinafter referred to as "the <br />Required Improvements." <br />E.
