RESOLUTION THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO.2021-138 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO.5 TO A NON-PROFESSIONAL SERVICES AGREEMENT WITH RUBICON LANDSCAPE CORPORATION FOR CITYWIDE TURF MAINTENANCE FOR $165,062.18 FOR FISCAL YEAR 2021-2022 WHEREAS, the City and Contractor have executed the Agreement, pursuant to which Contractor has provided certain services with regard to turf maintenance; and WHEREAS, the Parties desire to amend the Agreement to extend the term for one year and increase the service price by 3.8%; and WHEREAS, the City Council is familiar with the contents thereof; and WHEREAS, the City Manager recommends approval of said amendment. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That the following contract amendments are approved: 1. Section 1.1 of the Agreement entitled "Term of Service" is hereby amended to extend the term from July 1, 2021 to June 30, 2022; and 2. Section 2 of the Agreement entitled "Compensation" is hereby amended to pay Contractor a sum not to exceed $13,755.18 per month for a total of $165,062.18 per year for Fiscal Year 2021-2022; and 3. Exhibit A of the Agreement entitled "Scope of Services" is hereby amended in accordance with the attached: 4. Exhibit B of the Agreement entitled "Compensation Schedule" is hereby amended in accordance with the attached; and Introduced by Councilmember Cox and passed and adopted this 201h day, of September 2021, by the following vote: Members of the Council: AYES: Councilmembers Aguilar, Azevedo, Ballew, Cox, Lopez, Simon, Mayor Cutter (7) NOES: None (0) ABSENT: None ATTEST: c'a I.
