<br />AMENDMENT NUMBER ONE TO CONSULTING SERVICES AGREEMENT <br />BETWEEN <br />THE CITY OF SAN LEANDRO AND <br />BAY AREA AFFORDABLE HOMEOWNERSHIP ALLIANCE (BAAHA) <br />FOR <br />SAN LEANDRO HOMEBUYER PROGRAM <br /> <br /> <br />This Amendment Number One (“Amendment”) is made by and between the <br />City of San Leandro (“City”) and Bay Area Affordable Homeownership Alliance (BAAHA) <br />(“Consultant”) (together sometimes referred to as the “Parties”) as of October 18, 2021, <br />and amends that certain Community Development Block Grant Consultant Agreement <br />(“Agreement”) dated July 1, 2021, between the Parties. <br /> <br />WHEREAS, City and Consultant have executed the Agreement, pursuant to <br />which Consultant provides administration of a First Time Homebuyer Education and <br />Counseling Program and Below Market Rate (BMR) Asset Management. Consultant <br />employs staff, who have knowledge to provide these services, the organizational <br />infrastructure and capacity to deliver these services, and is familiar with the regulations <br />and requirements to conduct this work; and <br /> <br />WHEREAS, the Parties desire to amend the Agreement to increase the amount <br />of funding provided to Consultant to manage repairs to deferred maintenance and other <br />minor rehabilitation needs for the sale of the BMR property located at 713 Bloom Street <br />that was foreclosed by the City of San Leandro on May 13, 2021; and <br /> <br />NOW THEREFORE, for good and valuable consideration, the sufficiency of <br />which is hereby acknowledged, the Parties hereby agree as follows: <br /> <br />1. Section 2, “COMPENSATION”, of the Agreement is amended to increase the <br />maximum amount of City funds to be provided to Consultant by $40,255 to a total <br />amount of $76,185. <br /> <br />2. Exhibit B, “Budget” of the Agreement is hereby amended and replaced with <br />the revised Budget, attached to this Amendment as Exhibit B and incorporated herein. <br /> <br />3. All other terms shall remain in full force and effect. <br /> <br />4. This Amendment may be executed in multiple counterparts, each of which <br />shall be an original and all of which together shall constitute one agreement. The <br />persons whose signatures appear below certify that they are authorized to sign on <br />behalf of the respective Party. <br />
