The second reading of the Ordinance is agendized for September 20, 2021 and would <br />become effective on October 21, 2021. <br /> <br />FISCAL IMPACT <br />There is no direct fiscal impact from removing the Bay Fair TOD Second Reading from the table. <br />ENVIRONMENTAL REVIEW <br />Consistent with the City Council’s earlier review and action, the proposed amendments are <br />exempt from the California Environmental Quality Act (“CEQA”) based on the rule set forth in <br />CEQA Guidelines Section 15061(b)(3) that CEQA applies only to projects which have the <br />potential for causing a significant effect on the environment. <br />RECOMMENDATION <br />Staff recommends that in accordance with Robert’s Rules of Order, which govern the orderly <br />administration of City Council meetings per Section II of the City Council Handbook, the City <br />Council move to remove from the table the Second Reading of Ordinance No. 2020-12 amending <br />the Zoning Code, Zoning Map, and Municipal Code to implement the 2018 Bay Fair TOD <br />Specific Plan (Introduced on December 7, 2020).
