<br /> <br />A. The proposed development plan is allowed within the applicable district and complies with all other <br />applicable provisions of this Code and the San Leandro Municipal Code; <br /> <br />B. The proposed development plan is consistent with the General Plan and any applicable specific plan; <br /> <br />C. The proposed development plan will not be adverse to the public health, safety, or general welfare of <br />the community, nor detrimental to surrounding properties or improvements; <br /> <br />D. The design, location, size, and operating characteristics of the proposed development plan are com- <br />patible with the existing and reasonably foreseeable future land uses and circulation in the vicinity; and <br /> <br />E. The site is physically suitable for the type of use(s) being proposed, including access, utilities, and the <br />absence of physical constraints. <br /> <br />5.14.128 Conditions of Approval <br /> <br />In approving a development plan, reasonable conditions may be imposed as necessary to: <br /> <br />A. Achieve the general purposes of this Code or the specific purposes of the zoning district in which the <br />site is located or to make it consistent with the General Plan and any applicable specific plan; <br /> <br />B. Protect the public health, safety, and general welfare; <br /> <br />C. Ensure operation and maintenance of the use in a manner compatible with existing and potential uses <br />on adjoining properties or in the surrounding area; or <br /> <br />D. Prevent or mitigate potential adverse effects on the environment. <br /> <br />5.14.132 Effective Date; Appeals <br /> <br />A development plan shall become effective 15 days after action by the Board of Zoning Adjustments, unless <br />appealed to the City Council in accord with Chapter 5.20 Appeals. <br /> <br />5.14.136 Lapse of Approval; Transferability; Discontinuance; Revocation; Extension <br /> <br />A. Lapse of Approval. A development plan shall lapse after two years, or at an alternative time specified <br />as a condition of approval, after its date of approval unless: <br /> <br />1. A building permit has been issued, coupled with diligent progress evidencing a good faith intent <br />to commence the intended use; or <br /> <br />2. A certificate of occupancy has been issued; or <br /> <br />3. The approval is renewed, as provided for below. <br />
