receptacles and shall ensure organics collection receptacles are maintained in <br />an odor -free condition. <br />15.All exterior mechanical equipment such as air conditioning/heating units and <br />communications equipment shall be screened from view so as not to be visible <br />from adjacent properties or streets to the satisfaction of the Community <br />Development Director. <br />16.All electrical, gas, and water meters shall be located such that they will not be <br />visible from the streets, or these units shall be screened or enclosed. <br />17. Roof -mounted mechanical equipment shall be screened from view from public <br />streets, the elevated BART line, and on -site public parking and vehicular or <br />pedestrian circulation areas open to the public, or such equipment shall be <br />designed or treated so as to be unobtrusive or visually attractive, subject to <br />review and approval by the Community Development Director. <br />18. The property shall comply with all City noise ordinance standards. The operation <br />of any instrument, audio equipment, television set, machine or similar device <br />between the hours of 10:00 p.m. and 8:00 a.m. in a manner as to be plainly <br />audible at a distance of fifty (50) feet from the building shall be prohibited. <br />19.Outdoor loudspeakers and public announcement systems shall be prohibited <br />from installation and use. <br />20. Noise from any mechanical equipment, elevators or generators shall be <br />minimized and insulated from adjacent residential units and shall comply with the <br />City's Noise Ordinance. <br />21.All mechanical equipment shall be designed and maintained to comply with City <br />noise standards. <br />22. The approvals granted by the City as a result of this application, as well as the <br />Conditions of Approval, shall be recorded in the office of the County Recorder of <br />Alameda County prior to building permit issuance. <br />23. Pursuant to Government Code section 65913.4(f)(1) this approval shall not <br />expire if the project includes public investment in housing affordability, beyond <br />tax credits, where 50 percent of the units are affordable to households making <br />at or below 80 percent of the area median income. <br />Pursuant to Government Code section 65913.4(f)(3) this approval shall remain <br />valid for three years from the date of the final action establishing that approval <br />and shall remain valid thereafter as long as vertical construction of the <br />development has begun and is in progress. Additionally, the Applicant/Property <br />Owner may request, and the Zoning Enforcement Official shall have discretion <br />to grant without notice or a public hearing, an additional one-year extension to <br />the original three-year period.
