CONDITIONS OF APPROVAL <br />PLN21-0008 — 1933 Davis St. <br />Amended Planned Unit Development <br />Peter Lennon for B3 WESTGATE MANAGER, LLC. (Applicant) <br />and <br />for BRE WESTGATE PROPERTY OWNER, LLC. (Property Owner) <br />1. The applicant and property owner shall be responsible for assuring that any successor in interest <br />who assumes responsibility for this zoning approval is informed of its terms and conditions. <br />2. This Amended Planned Unit Development is an approval to align the use regulations with the <br />underlying zoning district. Conditions of Approval of the Original PUD (PD-86-9) are hereby <br />amended as follows: <br />a. Condition No. X of the original PUD ("Permitted and Prohibited Uses/Use <br />Restrictions"), is amended by modifying subsection (b)(1) by removing the following <br />land uses from the "prohibited use" list: personal service shops; schools or training <br />facilities; bowling alley; skating rink; and retail health spa or exercise facility. <br />b. All land uses regulated under the original PUD, General and Precise Development Plan <br />Combined (PD-86-9), approved by City Council on January 12, 1987 under Resolution <br />No. 87-8, shall be consistent with use regulations in the underlying Industrial Transition <br />(IT) zoning district, as specified in the Zoning Code. <br />Agreement to Conditions May 7, 2021 <br />PLN21-0008 Page 3 of 3 <br />
