City of San Leandro Meeting Date: January 18, 2022 Resolution - Council Agenda Section:File Number:21-756 CONSENT CALENDAR Agenda Number: TO:City Council FROM:Fran Robustelli City Manager BY:Keith Cooke Engineering & Transportation Director FINANCE REVIEW:Susan Hsieh Finance Director TITLE:RESOLUTION of the City of San Leandro City Council to Accept the Work for the Curb Ramp Upgrades 2021 Project, Project No. 2021.0070 (provides for acceptance of the work performed by Spencon Construction, Inc., Filing the Notice of Completion, Releasing the Performance and Payment Bonds, and Releasing the Maintenance Bond Upon Successful Completion of the One-Year Maintenance Period) WHEREAS, pursuant to a construction contract between the City of San Leandro and Spencon Construction, Inc., approved on June 1, 2021, by Resolution No. 2021-063, Spencon Construction, Inc. completed the Curb Ramp Upgrades 2021 Project, Project No. 2021.0070; and WHEREAS, said work was completed in accordance with the plans and specifications and to the satisfaction of the Engineering and Transportation Director, who therefore recommends that said work should be accepted. NOW, THEREFORE, the City Council of the City of San Leandro hereby RESOLVES as follows: 1. That the work hereinbefore described is hereby accepted; and 2. That the City Clerk is hereby directed to file a Notice of Completion on said project; and 3. That the bonds heretofore given for performance and payment of said conditions are hereby discharged and exonerated from further liability when the statute of limitations expires after the recording of the Notice of Completion; and 4. That upon completion of the one-year maintenance period established pursuant to said contract, and to the satisfaction of the Engineering and Transportation Director, the City Manager is hereby authorized to release the maintenance bond heretofore given for maintenance of the Page 1 City of San Leandro Printed on 1/14/2022 68
