Non-Discrimination <br /> <br />The City and the Union agree that there shall be no discrimination against any employee <br />because of Union activities or because of race, color, religion, sex, national origin, age, <br />marital status, disability, sexual orientation, or gender identity defined by applicable <br />Federal and State regulations. <br /> <br />Section 40. Professional Certification <br /> <br />All employees working in a full-time permanent position shall be reimbursed for obtaining <br />or renewing job-required certificates. <br /> <br />The City agrees to pay the cost of written and medical examinations and the difference in <br />the license renewal fees above a Class C Driver's License for those represented <br />employees who are required to obtain and maintain a Class B Driver's License. <br />Employees who possess a Class A license as of January 1, 2016, shall receive a 2.5% <br />pay differential. Thereafter, the Street Supervisor and Street Maintenance Worker I/II/III <br />employees assigned to the Public Works Paving section who obtain and maintain a Class <br />A license, and have demonstrated the ability to independently operate a Class A vehicle, <br />shall receive the 2.5% pay differential. Eligibility for the Class A pay differential for <br />employees in other sections shall be based on City operational need as determined by <br />the department head. Operational need shall be defined as an employee who can <br />reasonably be expected to use the license on at least an occasional basis. If eligibility is <br />denied, Union may request to meet and discuss the reason for denial. <br /> <br />Section 41. Standby Pay <br /> <br />A. Compensation <br /> <br />All employees (except Civilian Police Employees – see C. below) who are assigned <br />to standby duty to respond to emergencies, service calls, shift coverage or lone <br />operator support during their off shift hours, will be paid at the rate of two (2) hours <br />pay at the employee’s straight time hourly rate for each normal workday <br />(commencing with the end of the regular scheduled shift). Employees who are <br />required to standby on regularly scheduled days off (i.e. a twenty-four (24) hour <br />consecutive period) shall receive a total of three (3) hours pay at the employee’s <br />regular hourly rate for each day. Employees who are required to standby on a City <br />holiday (i.e. a twenty-four (24) hour consecutive period) shall receive a total of three <br />(3) hours pay at the employee’s regular hourly rate for each holiday. With the <br />exception of Public Works (below) each department will establish its own rules for <br />standby assignments. <br />
