subsidies pursuant to the existing Section 8 program or any successor <br />thereto. <br />2.6.2 Non -Discrimination. The Owner covenants by and for itself and any <br />successors in interest that there shall be no discrimination against or <br />segregation of any person or group of persons, on account of any basis <br />listed in subdivision (a) or (d) of Section 12955 of the Government Code, <br />as those bases are defined in Sections 12926, 12926.1, subdivision (m) and <br />paragraph (1) of subdivision (p) of Section 12955, and Section 12955.2 of <br />the Government Code, in the leasing, subleasing, transferring, use, <br />occupancy, tenure, or enjoyment of the Property and the Project, nor shall <br />the Owner itself or any person claiming under or through it establish or <br />permit any such practice or practices of discrimination or segregation with <br />reference to the selection, location, number, use or occupancy of tenants, <br />lessees, subtenants, sublessees or vendees of the Property. The foregoing <br />covenants shall run with the land. <br />3. Income Certification & Reporting <br />3.1 Reporting Requirements. <br />3.1.1 Tenant Certification. Owner or Owner's authorized agent shall obtain <br />from each household prior to initial occupancy of each Restricted Unit, <br />and on every anniversary thereafter, a written certificate containing all of <br />the following in such format and with such supporting documentation as <br />City may reasonably require: <br />(a) The identity and age of each member of the household; and <br />(b) Total household income. <br />3.1.2 The Owner shall make a good faith effort to verify that the income <br />provided by an applicant or occupying household in an income <br />certification is accurate by taking one or more of the following steps as a <br />part of the verification process: (1) obtain a pay stub for the most recent <br />pay period; (2) obtain an income tax return for the most recent tax year; <br />(3) conduct a credit agency or similar search; (4) obtain an income <br />verification form from the applicant's current employer; (5) obtain an <br />income verification form from the Social Security Administration and/or <br />the California Department of Social Services if the applicant receives <br />assistance from either of such agencies; or (6) if the applicant is <br />unemployed and has no such tax return, obtain another form of <br />independent verification. <br />3.1.3 Owner shall retain such certificates for not less than three (3) years, and <br />upon City's request, shall make the originals available for inspection by <br />City and shall provide copies of such certificates to City. <br />5056752.1 <br />
