RESOLUTION THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO.2022-047 <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO <br />APPROVE PARCEL MAP 11257 FOR 3081 & 3089 TEAGARDEN STREET. OWNER: <br />DS REAL PROPERTY INVESTORS LLC SUBDIVIDER AND APPLICANT: DAVIS <br />STREET COMMUNITY CENTER <br />WHEREAS, the subdivider, Davis Street Community Center, submitted Parcel Map <br />11257, a single -lot subdivision for commercial condominium purposes, to the City Council for <br />approval; and <br />WHEREAS, the City approved a Nonresidential Condominium Conversion (PLN21- <br />0035) on February 4, 2022, for the properties at 3081 & 3089 Teagarden Street, Assessor's <br />Parcel Number 077-1201-027-15; and <br />WHEREAS, the owner has agreed to satisfy the Conditions of Approval for Planning <br />Permit PLN21-0035 at a later date; the agreement will be filed with the County Recorder. The <br />developer has not provided a bond or other security to ensure performance; and <br />WHEREAS, the City previously approved a Conditional Use Permit (PLN17-0012) for <br />APN 077-1201-027-15 that was recorded on December 19, 2017 as Instrument No. 2017278934 <br />of Official Records of Alameda County because the property did not at the time conform to the <br />Zoning Code; and <br />WHEREAS, the City Engineer provides that said parcel map is technically correct, and <br />that the subdivider has complied with the provisions of San Leandro Municipal Code §7-1-210 et <br />seq. and with the provisions of the Subdivision Map Act; and <br />WHEREAS, the City's consulting Land Surveyor attests that said parcel map is <br />technically correct pursuant to California Government Code §66450(b); and <br />WHEREAS, the City Planner's Report for Parcel Map 11257 is incorporated herein. <br />NOW, THEREFORE, the City of San Leandro City Council RESOLVES as follows: <br />1. That said Parcel Map 11257 is categorically exempt from the environmental review <br />requirements of CEQA, under Title 5, Chapter I of the San Leandro Administrative Code; and <br />2. That said Parcel Map 11257 is hereby approved, subject to the City Engineer's Report as <br />well as the City Planner's Report, attached hereto and made a part hereof; and <br />3. That the City Clerk is hereby authorized and directed to execute the City Clerk's <br />Statement on Parcel Map 11257 and shall forward the executed map to the Alameda County <br />Recorder for recordation. <br />
