IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO.2022-077 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AMENDMENT NO. 1 TO NON-PROFESSIONAL SERVICES AGREEMENT WITH MV TRANSPORTATION, INC. FOR PARATRANSIT SERVICES FOR FISCAL YEAR 2022-2023 WHEREAS, an agreement dated July 1, 2020 exists between the City of San Leandro and MV Transportation, Inc.; and WHEREAS, MV Transportation, Inc. has provided shuttle services for the FLEX Shuttle program since 2003 in the City of San Leandro; and WHEREAS, the City Council supports the Shuttle program and allows these services to be available for the 50-year or older, or 18-year or older disabled and East Bay Paratransit certified; and WHEREAS, the City supports the mobility of seniors and the disabled; and WHEREAS, the City receives funding for these services through the Alameda County voter -approved Measures B and BB; and WHEREAS, the Alameda County Transportation Commission's Timely Use of Funds Policy encourages Measure B/Measure BB/Vehicle Registration Fee recipients to expend voter - approved transportation dollars expeditiously on transportation improvements and operations that the public can use and benefit from immediately; and WHEREAS, Amendment No. 1 to the agreement, a copy of which is attached, was presented to this City Council; and WHEREAS, the City Council is familiar with the contents thereof; and WHEREAS, the City Manager recommends approval of said amendment to the agreement. NOW, THEREFORE, the City of San Leandro City Council hereby RESOLVES as follows: That said amendment in a total amount not to exceed $604,582.89 is hereby approved; and 2. That the terms of the agreement will be memorialized in writing by the City Manager, subject to the approval of the City Attorney as to form; and That the City Manager is authorized to execute said agreement with MV Paratransit, Inc.; and 4. That an original executed agreement shall be provided to the City Clerk and be attached to and made a part of this resolution.
