Objective Development Standards <br />City Council Draft Code Amendments <br />A-83 <br />(e) Provide seating; <br />(f) Provide one or more plaques visible to the public stating <br />the right of the public to use the space, the type of open <br />space, and the hours of use; <br />(g) Maintain a smoke-free environment; and <br />(h) Provide at least one of the following: <br />• Site furnishings, including, but not limited to, tables, <br />chairs, and gathering places. <br />• Active recreation spaces, such as tot lot or playground, <br />sport court, or similar. <br />• Shading. <br />• Public art. <br />(4) Location. Publicly Accessible Open Space shall: <br />(a) Be located on the ground floor; <br />(b) Have a direct, accessible pedestrian connection to a <br />public right-of-way or easement. <br />ii. Alternative Compliance. <br />(1) Park Land Dedication. Park land dedicated and improved <br />consistent with Municipal Code Chapter 7-1 shall count towards <br />the required Publicly Accessible Open Space. <br />(2) Residential Projects with Fewer than 50 Units. Multi-family <br />residential and residential mixed-use developments with fewer <br />than 50 residential units may opt to pay the Park Facilities <br />Development Impact Fee established by Municipal Code Chapter <br />7-13 in lieu of providing dedicated and improved park land and/or <br />Publicly Accessible Open Space. <br />(3) Programmed Use. Publicly Accessible Open Space designed for <br />concentrated and programmed public use – such as playgrounds, <br />recreational areas, or other programmed public spaces – may be <br />credited at a 2:1 ratio with approval of an Administrative <br />Exception per Chapter 5.06. <br />3. Lighting. <br />a. Lighting Design. <br />i. Maximum Height of Freestanding Lighting Standards. The maximum <br />height of a freestanding lighting standard is as follows: <br />(1) Within 100 feet of a Residential District: 16 feet. <br />132
