Objective Development Standards <br />City Council Draft Code Amendments <br />A-105 <br />Title 5—Administration <br />Chapter 5.06 Administrative Except ions <br />A. Purpose. The purpose of this Chapter is to establish a means of granting relief from locational, <br />developmental, and operational standards where doing so would be consistent with the purposes <br />of this Code and the General Plan, and where it is not possible or practical to approve a Variance. <br />B. Standards for Which an Administrative Exception May be Approved. The Zoning Enforcement <br />Official may approve an Administrative Exception as specifically identified in any section of this <br />Code. <br />C. Application Requirements. Application for such approval shall be made to the Zoning Enforcement <br />Official on a form prescribed by Planning staff. <br />D. Procedures. <br />1. Review Authority. The Zoning Enforcement Official shall act as the Review Authority for <br />Administrative Exception applications based on consideration of the requirements of this <br />Chapter except in the case of concurrent processing pursuant to Subsection D.5, below. <br />2. Findings Necessary for Approval. The Zoning Enforcement Official may approve an <br />Administrative Exception upon a determination that the proposal would not be detrimental <br />to public health, safety or welfare and would not cause undue damage, hardship, nuisance <br />or other detriment to persons or property in the vicinity. The Zoning Enforcement Official <br />shall deny, approve or conditionally approve the application. <br />3. Notice of Decision. The Zoning Enforcement Official shall notify by mail the applicant and <br />all abutting property owners. Said notice shall contain a statement that the action taken <br />will become final within 15 days from the date thereof unless appealed in writing to the <br />Board of Zoning Adjustments. The action of the Zoning Enforcement Official shall be final <br />unless an appeal is filed. <br />4. Appeals. Any person aggrieved with the action of the Zoning Enfo rcement Official may <br />appeal such action to the Board of Zoning Adjustments, pursuant to the requirements of <br />Chapter 5.20 Appeals. <br />5. Concurrent Processing. If a request for an Administrative Exception is being submitted in <br />conjunction with an application for another approval, permit, or entitlement that requires <br />review or action by the Planning Commission/Board of Zoning Adjustments or another <br />review body, it shall be heard and acted upon at the same time and in the same manner as <br />that application and subject to the noticing and appeal procedures therein. <br />154
