General Exceptions to Height Limits. The maximum height of a structure, other than in the RS-VP <br />District, shall be subject to the regulations of Section 4.04.320 Exceptions to Height Limits. <br />B. Upper Story in RD or RM Districts. Residential construction projects that create or enlarge an upper <br />story are subject to Chapter 5.12 Site Plan Approval. <br />C. Two-Story or Three-Story in RO, RS, and RS-40 Districts. Residential construction projects that <br />create or enlarge a second or third story are subject to Section 2.04.408 RO, RS and RS-40 <br />Districts—Residential Site Plan Review. <br />D. Additional Height Restriction in RO District. Any portion of a dwelling located within 20 feet of the <br />rear lot line shall not exceed 15 feet in height. <br />EC. Additional Height Restrictions in RS-VP Sub-District. <br />1. Alternate Definition to Measure Maximum Height of Structure in RS-VP Sub-District. <br />Notwithstanding the definition of “Height” in Section 1.12.108 Definitions, the height of a <br />structure in the RS-VP sub-district shall not exceed a height of 18 feet, as defined below: <br />a. Establishing Maximum Building Height. The 18-foot height limit is established by <br />an assumed plane 18 feet above existing grade, as measured perpendicularly from <br />the existing grade. Except for chimneys, vents, and non-commercial reception <br />antennas, no portion of the structure, including any part of the roof, may exceed <br />this 18 feet height limit. (See illustration “Examples of 18 Foot Height Limit.”) <br />b. Documenting Compliance with Maximum Building Height. As part of any <br />application for View Preservation/Site Plan Review (which is required for any <br />development in the RS-VP sub-district, as per Section 2.04.412 RS-VP Sub- <br />District—Residential Site Plan Review and Exceptions to Height Restrictions), <br />56
