100. No objectionable odors or vibration emanating from the project site shall be detectable beyond the <br />subject property. The City may require installation of vibration control measures or odor control <br />measures including but not limited to the installation of air filters, misting systems, carbon <br />adsorbers, odor control blocks, passive or active vibration control measures, or wind screens and/or <br />require changes in site operations. <br />101. All uses shall comply with all City noise ordinance standards, as enumerated in Section 4-1-1115 of <br />the Municipal Code. In part: <br />a. Construction -related noise near residences is restricted to between the hours of 7:00 a.m. <br />and 7:00 p.m. Monday through Friday, and between the hours of 8:00 a.m. and 7:00 p.m. <br />on Saturday and Sunday. <br />b. The sustained operation of any motor or engine or the repair, modification, testing, or <br />operation of such a motor or engine shall be prohibited between the hours of 9:00 p.m. <br />and 8:00 a.m. unless the motor, machine, or device is enclosed within a sound -insulated <br />structure. <br />c. The playing of music, stereos, televisions, or other similar device in such a manner as to <br />be plainly audible at a distance of 50 feet from the building or vehicle in which it is <br />located is prohibited between the hours of 10:00 p.m. and 8:00 a.m. <br />102. The project site and public right of way shall be well maintained and shall be kept free of litter, <br />debris and weeds. Street trees and tree wells shall be maintained. Property management and the <br />HOA shall be responsible for the maintenance of the project site and adjacent public right-of-way. <br />103. Balconies and patio areas shall be kept in a neat and clean condition at all times and shall not be <br />used for storage. Access to patio doors shall be maintained unobstructed for emergency access. <br />104. Pet waste shall be promptly removed and properly disposed from all property sidewalks, pet areas, <br />and landscaping. An outdoor pet waste disposal receptacle shall be provided and maintained if <br />pets are permitted in common areas. <br />105. All fencing and walls on the project site shall be structurally sound, graffiti- free and well <br />maintained at all times. <br />106. All landscaping improvements shall be maintained in a healthy, growing condition at all times. <br />Street trees and tree wells shall be maintained. All landscape and irrigation shall be well - <br />maintained continuously, and any dead or dying plants or trees shall be promptly replaced. <br />107. All trees shall be planted so that at maturity they are located far enough away from the sidewalk <br />so that their branches are at least eight (8) feet above the sidewalk area and 14 feet above the <br />roadway/vehicle traveled way. Tree removal, trimming, and other vegetation removal shall be <br />completed between outside of bird nesting season. <br />108. The Applicant/Developer shall ensure that trees planted within 10 feet of any paved or concrete <br />area include a root control barrier and deep watering sleeve, the design of which shall be subject <br />to approval by the Engineering and Transportation and Public Works Departments. <br />Recommended Conditions of Approval June 21, 2022 <br />PLN22-0008, PLN21-0020 & PLN21-0021 Page 22 of 39 <br />
