1 <br /> <br /> <br />UP Real Estate Folder No.: 3271-85 <br />Audit Number SPA4491 <br /> <br /> <br />PUBLIC HIGHWAY AT-GRADE CROSSING AGREEMENT <br /> <br />Halcyon Dr. <br />DOT 749744E <br />Mile Post 16.74 – Niles Subdivision <br />San Leandro, Alameda County, California <br /> <br /> <br />THIS AGREEMENT ("Agreement") is made and entered into as of the ____ day of <br />___________, 2022 ("Effective Date"), by and between UNION PACIFIC RAILROAD <br />COMPANY, a Delaware corporation, to be addressed at Real Estate Department, 1400 <br />Douglas Street, Mail Stop 1690, Omaha, Nebraska 68179 (”Railroad") and CITY OF SAN <br />LEANDRO, a municipal corporation or political subdivision of the State of <br />_______________ to be addressed at 835 East 14th St., San Leandro, CA 94577 <br />("Political Body"). <br /> <br />RECITALS: <br /> <br /> <br />The Political Body is using and maintaining the exis ting Halcyon Dr., at grade <br />public road crossing over Halcyon Dr., DOT 749744E at Railroad’s Milepost 16.74 on <br />Railroad’s Niles Sub., at or near San Leandro, Alameda County, California. <br /> <br />The Political Body now desires to undertake as its project (the “Project”) the <br />reconstruction and widening of the Halcyon road crossing, in the location as shown on <br />the Exhibit A survey print and as further detailed in the Exhibit A-1 detailed print, with <br />the widening of the existing Halcyon Dr., at-grade road crossing to include the installation <br />of a CPUC Standard 9-A (gate and cantilever) in the northeast quadrant and in the east <br />median; the installation of a CPUC Standard 8 (pedestrian flasher) in the northwest <br />quadrant (“Additional Crossing Area’); and updating the existing interconnection between <br />the Railroad and traffic signals to 16 seconds of advanced preemption. The Halcyon Dr., <br />at-grade road crossing, including the Existing Crossing Area, and the widening, the New <br />Sidewalk and the Additional Crossing Area, as reconstructed and as described as the <br />blue hatched area in Exhibit A, and the Exhibit A-1 detailed prints, is hereinafter the <br />“Roadway” and the portion of the Railroad's property where the Roadway crosses the <br />Railroad’s property is the “Crossing Area.” Exhibit A and Exhibit A-1 are attached hereto <br />and made a part hereof. <br /> <br />The right of way used and maintained by the Political Body at the Roadway is not <br />sufficient to allow for the reconstruction of the Roadway.
