McGaWan: By all means. <br />Guss: I remember you when I first applied for the permit. I think a couple of others here were <br />on the Board at that time. You specifically, as Chairman, told my neighbors: Phelps, Arrow <br />"ruck Parts, that in order for me to get the permit, I would have to clean up the road and you <br />:xpected them to contribute towards the clean-up. That is in the minutes and that was stated at <br />the time I applied. C&G Contractors have spent over $20,000 just fixing the road, which is a dirt <br />road with gravel on it, from Doolittle to the end of Eden Road where you saw the gate on the <br />screen. I did that myself, our firm did and all the expense came out of my pocket or the <br />company's pocket. That is one of the reasons why over the three year period that I have not <br />accumulated much working capital because my money has been spent, although I am stockpiling <br />material in the yard, my money has been spent on compliance making the road so it is passable. <br />I remember one of the Board members said, "We have to park our car out on Doolittle and walk <br />to the end when we visit the site." Now, you can drive down there, turn and drive out. I did put <br />two speed bumps at my expense in front of Arrow Truck Parts wrecking yard because he was a <br />constant complainer so trucks would not exceed 5 mph. <br />I would also like to say this about my personal reputation. I am a deacon in church and a <br />Christian man. I mean well. I believe in honor and respect. Some of the things that have <br />happened to me happened because, number one, I am the new person on the block. Number two <br />is that the land was available and some of my neighbors did not know the land was available . <br />when I made a deal with the owner of Galbraith Golf Course, who had control of the land. I have <br />in writing that I have never encroached onto Galbraith property without permission. I would like <br />to give this to you, sir, if you would like to look at it. (Mr. Guss handed Chairman McGallian a <br />copy of a letter from .4art C. de Vos, Chief Financial Officer of Ransom, McKay Golf, Inc. re: <br />'roposed Joint Venture Agreement.) <br />I also brought something that pertains to me and my reputation and that is that I have worked <br />%vith the Cin, of San Leandro since 1962 with Joe Bautista and Doug Federighi and during the <br />last three phases of Bay-O-Vista. Our company did all the improvements up there. I have also <br />worked "ith Joe Bautista on various jobs. When Doug Federic, left Bay-O-Vista and moved to <br />Lafayene, I am the one who graded his house and dug his swimming pool. I am personal friends <br />with Joe Bautista, who used to be an engineer with the City of San Leandro. Jerry Guss does <br />not have a reputation of being the bad person. I am not intimating that the City is saying I am <br />bad. I was grateful that the City gave me the opportunity to do business here. Because of the <br />ne22.111,'e things I had heard, I was a little afraid to ask for permission, but it was approved <br />unanimously for me. The only thing is that mv:neiahbors have never contributed one dime <br />towards fixing the road or making it passable. When I first incurred the site, the was 30 feet of <br />concret: just past Arrow Truck Parts and all the way to the gate, which is a fire road to get into <br />the sl-waQe treatment plant, and all that concrete was moved at our expense. That was one of the <br />conditions. I have done all that, I honestly have. <br />The only thing I have not done is that when I got into the business and people knew that I used to <br />w n the `VI-st V, inton Landfill operation at West Winton in Hayward, that hauling to San <br />Leandro or Oakland it would be closer to come to my site at Eden Road rather than drive all the <br />way to Harvard. So, I ended up getting a lot of material in the winter time when other dumps <br />ould not accept it.
