Regular Meeting <br />that these Comments be Transcribed ) (April 19, 1999) <br />"Verbatim." ) <br />COMMENTARY <br />Public Speaking Rules And Fraudulence <br />No matter the reasoning, the city's desire to have more forceful control over <br />individual public participation in open public meetings they/the city changed <br />public speaking rules, doing so without a public hearing. <br />The matter of controlling individual public speech was enacted through the use <br />OF a city mandated "Speaker Card" policy. This city council and city' manager <br />had been advised by the city attorney that the speaker card policy is a lawful <br />reasonable regulation. Also, that his "view" has support from other California <br />attorneys. <br />Its already been established, that those city speaker card rules, will not be <br />able to pass the test of legality, or even the Ralph M.Brown Act provisions. <br />Truly, California has attorneys who also are not in agreement with the City of <br />San Leandro's legal argument! <br />The issue here is not the use of so-called speaker cards -- the issue is their <br />clear unlawful use when any individual speaker is mandatorily required to fill <br />out and turn in a speaker card before the public meeting even starts, any such <br />required act in itself is (card -shuffling speaker control) and is manipulation <br />in its worst form, not only controls but, its use can suppress any (individual <br />public speakers certain viewpoint!) <br />What has been taking place here -- is factual misuse of the Council Members <br />Handbook, the City Charter, and the Brown Act's provisions for a speaker's <br />rights: That is the individual right to 'speak' before, during and after on <br />any item on the public open meeting agenda! <br />Respectfully submitted, <br />/S/ Lou Filipovich, Non -partisan <br />Candidate for Public Office <br />15376 Laverne Drive <br />San Leandro, CA 94579-2045 <br />(510) 357-0555 <br />-1- <br />
