Julius, W.E. Jessup, Jr., P. Caloyeras, and The De Silva Group (property owners) <br />Rezone <br />1. The proposed rezone must be in general agreement with the adopted General Plan <br />of the City. <br />The General Plan designates the vicinity as a "No Change" area (General Plan Map 19, <br />Land Use Element). A "No Change" area will not remain entirely static and it is <br />expected that there will be a range of proposals to replace, renew or modify existing <br />development in these areas. The proposal to reclassify the property from IL Industrial <br />Limited District to RS(PD) Residential Single -Family Planned Development Overlay <br />District will phase out industrial sites which are adjacent to an existing low density <br />residential neighborhood. This will be compatible with the other existing single-family <br />uses in the vicinity. The rezone will encourage a beneficial change towards low -density <br />residential development, which will protect the existing area from any more potential <br />impacts from industrial uses such as noise and truck traffic, which has been found to <br />erode the stability of residential uses. <br />The rezone from IL to RS(PD) District will protect the immediate properties and <br />occupants from any inappropriate use and potentially significant impacts by allowing <br />residential development subject to discretionary review for any future projects or change <br />of use of the land. <br />2. The uses permitted by the proposed zoning district must be compatible with existing <br />and proposed uses in the general neighborhood. <br />The uses permitted by the RS(PD) District are the same uses permitted in the RS District. <br />The RS(PD) designation will allow for a Planned Development (PD) application for the <br />Planning Commission and City Council to review. The previous rezone of adjacent <br />properties from industrial to residential zoning districts has established the precedent that <br />single-family residential uses would replace the older and abandoned industrial uses. <br />3. The property subject to the rezone will be served by streets, utilities and other <br />public facilities of sufficient capacity to properly serve it without overloading and <br />without detriment to other areas presently zoned in contemplation of full use and <br />availability of such facilities. <br />9� <br />
