Applicant applied for and received approval for a Planned Development and a Vesting <br />Tentative Map Tract No. 7078, to construct a 354-unit residential subdivision in a 44.6 acre area known as <br />the Peralta Avenue Area, Assessor's Parcel Numbers 75-155-1-2, 2-2, 2-8, 2-11, 2-12, 4, 75-207-1, 3-1, 4- <br />1, 5-1, 6-1, 6-4, 7-1, 7-2, 7-3, and 8-2. An Agreement to Conditions was entered into between the city and <br />the Applicant on February 16, 1999 and included Conditions of Approval. <br />B. The Conditions of Approval included Condition XII, entitled the Inclusionary Condition. <br />The Inclusionary Condition, by its terms, permitted amendment of the Inclusionary Condition by the City of <br />San Leandro Redevelopment Agency. <br />Amended Conditions of Approval <br />PD 98-2 Page 1 <br />
