Creekside Community Church 3 September 26, 2000 <br />A-00-2/PD-00-1 <br />Environmental Review <br />Under the California Environmental Quality Act (CEQA), the rezoning and planned <br />development are categorically exempt from CEQA as the reuse of an existing building <br />and minor modification to land use regulations under Article 129, Section 15301 Class 1. <br />Therefore, no environmental review is required. <br />Code Compliance Review <br />N/A <br />Board/Commission Findings <br />This proposal has been reviewed for its consistency with the General Plan and its impact <br />on the neighborhood. The Planning Commission finds that that the zoning change and <br />the planned development are consistent with the General Plan and will upgrade this <br />property. With the possibility of church members parking on the east side of Mac Arthur <br />Boulevard and crossing the street the Commission expressed concern on their safety. <br />They suggested the possibility of signage advising pedestrians use the legal crosswalk at <br />Mac Arthur Boulevard and Dutton Avenue. There were numerous speakers representing <br />Creekside Community Church in support of the proposal. Many of the speakers live in <br />the immediate area. John Goodman, president of the Broadmoor Neighborhood <br />Association, also spoke in support of the application. He called the project beneficial to <br />the entire community. The findings adopted by the Planning Commission are included as <br />an attachment to this report. <br />Summary Of Public Outreach Efforts <br />As required by State law, a public notice was mailed to all property owners within 300 <br />feet of the project site. Notice was also published in the Daily Review and posted in the <br />surrounding neighborhood. The notice briefly described the project and included the <br />phone number of the project planner for response to any questions regarding the proposal. <br />Prior to submitting the application for the project, the applicant also mailed notice to all <br />property owners within 300 feet of the project inviting them to a meeting on the project. <br />Only two homeowners showed up to the meeting and there was no opposition to the <br />proposal. They also met with the Estudillo Homeowners Association and the Broadmoor <br />Neighborhood Association and both groups were supportive of the proposal. <br />On March 22, 2000, the church met with the West San Leandro/Mac Arthur Boulevard <br />Redevelopment Advisory Committee to present the proposal. By motion the RAC <br />unanimously agreed that it saw no adverse impacts to the redevelopment of the site as <br />proposed except that there would be a financial impact to the Redevelopment Project <br />Area due to the tax-exempt status of the church. However, despite the fact that the <br />presence of the church will preclude receiving any tax increment from this site, they <br />recommended project approval subject to the normal planning review process. <br />
