CITY OF SAN LEANDRO <br />SEXUAL HARASSMENT/DISCRIMINATION <br />PREVENTION POLICY <br />I. POLICY <br />It is the policy of the City of San Leandro that employees should have a working <br />environment free of unlawful and improper sexual harassment and unlawful discrimination <br />based on sex, race, color, national origin, ancestry, religion, physical or mental disability, <br />marital status, sexual orientation, medical condition, age, or any other protected <br />classification. The work environment should be businesslike and assure fair, courteous <br />treatment for employees and the public. Sexual harassment and illegal discrimination are <br />considered serious acts of misconduct and shall not be tolerated. Employees who violate <br />this policy and engage in acts of sexual harassment or illegal discrimination of any type, for <br />any duration, shall be subject to severe disciplinary action, up to and including termination. <br />Retaliation against individuals who complain of sexual harassment or any type of prohibited <br />discrimination or who participate in an investigation into sexual harassment or discrimination <br />shall not be tolerated. Employees who engage in acts of retaliation shall be subject to serious <br />disciplinary action, up to and including termination. <br />II. PURPOSE <br />The purpose of this policy is to comply with the requirements of Federal and State Law and <br />to ensure that employees understand that acts of sexual harassment or any type of prohibited <br />discrimination will not be tolerated by the City. <br />III. DEFINITION <br />Sexual Harassment: Applicable state and federal law defines sexual harassment as <br />unwanted sexual advances, requests for sexual favors, or visual, verbal, or physical <br />conduct of a sexual nature when: <br />A. Submission to the conduct is made a term or condition of employment; <br />B. Submission to or rejection of the conduct is used as a basis for employment <br />decisions affecting the individual; or <br />C. The conduct has the purpose or effect of unreasonably interfering with the <br />employees work performance or creating an intimidating, hostile, or offensive <br />working environment. <br />It is unlawful for males to sexually harass females or other males, and for females to <br />sexually harass males or other females.
