Minutes — City of San Leandro City Council Meeting Page 2 <br />July 26, 1999 <br />3. OPEN SESSION <br />The City Council reconvened in Open Session. <br />A. Report on Closed Session Actions Taken. <br />1. Conference with Labor Negotiators, Government Code Section 54957.6. <br />Agency Negotiators: John Jermanis, City Manager <br />Steve Harman, Human Resources Director <br />Employee Organization: San Leandro Management Organization <br />San Leandro City Employees' Association <br />The Assistant City Attorney reported that no action was taken. <br />2. Conference with Legal Counsel — Anticipated Litigation, Pursuant to <br />Government Code Section 54956.9. <br />Significant Exposure to Litigation 54956.9 (b). <br />No. of Potential Cases: 1 <br />Assistant City Attorney Liane Randolph stated that the City Council <br />directed staff to mitigate the possibility of anticipated litigation by <br />exploring other means to deal with refuse and recycling rate issues; <br />therefore, there will be no Public Hearing regarding refuse and recycling <br />rate increases on August 2, 1999. <br />3. Conference with Legal Counsel — Existing Litigation, Government Code Section <br />54956.9. <br />Name of Case: City of San Leandro vs. Port of Oakland <br />The Mayor stated that, in Closed Session, the City Council decided to <br />initiate further litigation against the Port of Oakland. The City has <br />reviewed the Supplemental Environmental Impact Report (EIR) and <br />believes it still does not provide an adequate environmental analysis of the <br />effects of the Airport's proposed expansion. The City will file a petition <br />this week requesting the court to order the Port of Oakland to conduct <br />further environmental study. <br />4. ADJOURN <br />~. l l <br />The City Council adjourned its Closed Session meeting at 7:10 p.m. <br />
