City Council Staff Report August 31, 1999 <br />A-99-2 & PD-99-2 Page 5 of 8 <br />Recommended Amendments to Conditions of Approval <br />In response to the above items, staff recommends several additions and revisions to clarify the <br />recommended conditions of approval. Proposed revisions are as follows: <br />IV. LANDSCAPING <br />B. Prior to issuance of a building permit, the developer shall: <br />Contact by certified mail each property owner that abuts the channel opposite the <br />hotel (9 properties) and offer to provide and/or install a 24" box tree or other <br />landscaping and/or install solid fencing, at the property owner's option, in the <br />backyard of these residences for visual screening. Trees shall be donated or <br />planted and fencing shall be installed prior to approval of occupancy for the hotel. <br />2. Explore with the Alameda County Flood Control & Water Conservation <br />District (ACFCWCD) the possibility of obtaining permission to plant <br />additional 24" box trees along the south side of the flood control channel <br />opposite the hotel project. If permission is granted, trees shall be planted <br />prior to approval of occupancy for the project or as otherwise directed by the <br />ACFCWCD. (Added portion) <br />VI. ENGINEERING AND TRANSPORTATION REQUIREMENTS <br />A. GENERAL CONDITIONS <br />3. The Developer has also applied for a Parcel Map for this project. In addition to the <br />subdivision into two lots, the Parcel Map Application also provides for the transfer <br />of land between the Applicant and Alameda County Flood Control & Water Control <br />district (ACFCWCD). Prior to the issuance of any building permits for this project, <br />the Parcel Map shall be approved by the City Engineer and recorded with the <br />County Recorder's Office. (At the discretion of the City Engineer, a grading or <br />building permit may be issued prior to recordation of the Parcel Map). The signed <br />agreements with ACFCWCD and/or grant deeds shall be submitted to the City <br />Engineer for review and approval. If an agreement from ACFCWCD cannot be <br />obtained and an alteration to the site plan is necessary, a revised plan shall <br />be submitted for review and approval by the Development Services Director <br />with possible referral to the Planning Commission. Prior to the issuance of building permits for the project, the developer shall obtain <br />all required Encroachment Permit(s) or comparable approvals from governing <br />agencies for any work within any public right-of-way, to the satisfaction of the <br />City Engineer.
