California Department of Fish and Game CERTIFICATE OF FEE EXEMPTION Project Title/Location (include County): A-99-3, PD-99-3 and Vesting Tentative Map Tract 7133; 1355 and 1358 Santa Rosa Street, 391 and 393 Estudillo Avenue and 380, 384 and 390 Joaquin Avenue, San Leandro California, Alameda County, 94577 Project Description: Rezone the property from P Professional District to RM-2500 (PD) Residential Multi -Family Planned Development Overlay District. The planned development is for the construction of eleven (11) three - bedroom and two -bath two-story townhouse units on a vacant 23,722 square foot parcel. The vesting tentative map will create 11 individual parcels for the sale of the units. Findings of Exemption: 1. The City Council approved the proposal to rezone the property to a residential district with a planned development overlay district and to construct the 11 townhouse units on the site. Included was the vesting tentative map for the individual sale of the units. 2. An initial study has been conducted to evaluate potential adverse environmental impacts. 3. The City Council finds and determines that, when considering the record as a whole, there is no evidence before the City that the proposed project will have the potential for an adverse effect on the wildlife resources or the habitat on which wildlife depends. 4. The City Council, based on the substantial evidence incorporated on the initial study, negative declaration, and staff reports, rebuts to presumption of adverse effect provided in Section 753.5(d) of Title 14, California Code of Regulations. Certification: I hereby certify that the lead agency has made the above findings and that based upon the initial study and hearing record, the project will not individually or cumulatively have an adverse effect on wildlife resources, as defined in Section 711.2 of the California Fish and Game Code.
