Jennanis <br />City Manager <br />On December 11, 1997 the Planning Commission held a Public Hearing regarding an appeal of the City <br />Engineer's approval of a Lot Line Adjustment Map at 1933 Davis Street and 1944 Williams Street. <br />Upon the conclusion of Public Hearing, the Planning Commission unanimously upheld the City <br />Engineer's approval of the map. On December 19, 1997, Daniel Cardozo of Adams Broadwell & Joseph <br />appealed the Planning Commission's decision to the City Council on behalf of the United Food & <br />Commercial Workers Union, Local 870, Marla Donati, Debbora LaFranco, Alice Keeling and Ron <br />Fogelson. <br />Staff recommends that the City Council deny the appeal, and thus uphold the Planning Commission's <br />and City Engineer's approval of the Lot Line Adjustment Map (LLAM). <br />BACKGROUND <br />On September 16, 1997, an application was received from Monarch Ventures, Costco Wholesale <br />Corporation (Costco) and Insured Transporters, Inc., (ITS) for a LLAM between their three contiguous <br />parcels. The maps, legal descriptions and plats submitted by the applicants were reviewed by staff for <br />conformance with the California Subdivision Map Act and San Leandro Municipal Ordinances. The <br />LLAM was approved by the City Engineer on October 10, 1997. <br />On October 13, 1997, the City Engineer's approval of the LLAM was appealed to the Planning <br />Commission. The appeal heard by the Planning Commission on December 11, 1997, was based on the <br />premise that the LLAM did not meet the conditions of approval contained within the San Leandro <br />Subdivision Ordinance. After the hearing, the Planning Commission upheld the City Engineer's <br />approval of the LLAM. Subsequently, on December 19, 1997, Daniel Cardozo of Adams Broadwell & <br />Joseph filed an appeal of the Planning Commissions decision to the City Council. <br />
