They shall be reported as compensation for retirement (9%) <br />purposes. The City will not treat these contributions as compensation subject to income tax <br />withholding unless the Internal Revenue Service or Franchise Tax Board determines that such <br />contributions are taxable income subject to withholding. <br />Each employee is solely and personally responsible for any federal, state or local tax liability of the <br />employee that may arise out of the implementation of this section or any penalty that may be <br />imposed therefore. <br />Except as set forth in the following paragraph the aforesaid contribution shall be considered solely <br />for the purpose set forth herein and shall not be considered for any other purpose, including but <br />not limited to being considered as part of any employee's salary for the purpose of computing <br />straight time earnings, compensation for paid leaves, compensation for overtime worked, <br />compensation benefits. The City reserves the right to take said contributions into account for the <br />purpose of salary comparisons with other employers. <br />23 <br />
