4.5 The parties agree that there shall be no restraint, coercion, <br />or interference with any employee with respect to or because <br />of the employee's Association membership, activities, or <br />support, or lack thereof. No employee shall be discriminated <br />against because of said membership, activity, or support, or <br />lack thereof, or because of the exercising of his/her rights <br />under this Memorandum of Understanding. <br />Section S. City Rights <br />The rights of the City include, but are not limited to, the <br />exclusive right to determine the mission of its constituent <br />departments, commissions and boards; set standards of <br />service; determine the procedures and standards of <br />selection for employment and promotion; d i r e c t it s <br />employees; take disciplinary action; relieve its employees <br />from duty because of lack of work or for other legitimate <br />reasons; maintain the efficiency of governmental <br />operations; determine the methods, means and personnel by <br />which government operations are to be conducted; determine <br />the content of job classifications; take all necessary <br />actions to carry out its mission in emergencies; and <br />exercise complete control and discretion over its <br />organization and the technology of performing its work, <br />except as modified by other provisions in this Memorandum <br />of Understanding. <br />Section 6. Pay and Classification <br />The recognized classifications and those rates of pay which <br />are to be effective during the period of this Memorandum of <br />Understanding are enumerated in Appendix "A" which is <br />attached hereto and made a part hereof. <br />Effective January 1, 1998, salaries shall be increased by <br />two (2%) percent for all unit classifications. <br />Effective July 1, 1998, salaries shall be increased by two <br />(2%) percent for all unit classifications. <br />Effective January 1, 1999, salaries shall be increased by <br />three (3%) percent for all unit classifications. <br />Section 7._Annual Vacation Leave <br />7.1 The purpose of annual vacation leave is to enable each <br />eligible employee to return to work physically and mentally <br />refreshed. In the administration of this section, <br />administrative personnel shall be guided by this stated <br />purpose. The time at which an employee shall take vacation <br />leave during the calendar year shall be determined with due <br />regard for wishes of the employee, and particular regard <br />for the needs of the department.
