position in his/her present classification provided the <br />department head into which the transfer is proposed agrees <br />or (2) continuing in the same position in the lower <br />classification and within the pay range of the lower <br />classification as close as possible to the rate of pay <br />which the employee had had in the prior position. <br />Section 16. Iniury on Duty <br />When an employee is incapable of performing his work or <br />duties as a result of injuries received or illness arising <br />in the course of his/her employment by the City and <br />receives benefits pursuant to the Workers' Compensation <br />Act, upon the sole discretion of the City Manager, a full- <br />time competitive service employee hired pursuant to the <br />merit personnel program may be granted a leave with an <br />amount of pay equal to the difference between his/her City <br />pay and the Workers' Compensation pay benefit, if any, <br />received by him/her during such incapacity, but not to <br />exceed one (1) year for any one (1) period of such <br />incapacity. <br />Leave granted an employee under the above provisions shall <br />not be considered sick leave or deducted from accumulated <br />sick leave. <br />When an employee has been injured in the line of duty and <br />receives compensation in accordance with the provisions of <br />any Workers' Compensation Act of the State of California, <br />the Personnel Director shall have submitted to him/her <br />reports on the forms in the manner prescribed. <br />An employee injured in the line of duty who requires <br />medical care and/or physical therapy shall schedule, as far <br />as practicable, such appointments at a time so as to be as <br />least disruptive to the work schedule. <br />Section 17. Hours of Work <br />A work week shall be computed as the number of hours <br />customarily considered as a full week's work in the <br />classification and in the department in which the person is <br />employed. <br />Employees assigned to the Water Pollution Control Plant who <br />are regularly assigned to eight (8) hour shifts starting at <br />or after 3:45 p.m. (swing) and ending at or prior to 8:00 <br />a.m. (graveyard) shall receive a shift differential of One <br />Hundred Fifty-five Dollars ($155) per month while so <br />assigned. Employees who are regularly assigned to provide <br />relief assignments for swing and/or graveyard shift(s) <br />shall receive a shift differential for the time spent <br />working on such shift(s). <br />16 <br />
