Meyers, City Attorney <br />Gayle Petersen, City Clerk <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br />Jo Jermanis M0 <br />Ci anager <br />qg_S3 <br />oS-Ig-gig <br />Subject: Referendum Petitions Submitted Regarding Resolution No. 98-26, Lease <br />Agreements and Other Documents Between the San Francisco Bay Conference <br />Center Resort, L.L.C., and the City of San Leandro Regarding the Network <br />Conference Center. <br />SUMMARY AND RECOMMENDATION <br />The City Council has received Referendum Petitions regarding the Network Conference Center <br />which have been reviewed and signatures verified, therefore rendering the petitions sufficient. <br />The Council must now act to rescind the Resolution under referendum, or set the issue for an <br />election to take place no earlier than 88 days from the date of certification of the petitions from <br />the City Clerk. <br />BACKGROUND <br />The City Council adopted Resolution No. 98-26 Approving Lease and Other Documents Between <br />the San Francisco Bay Conference Center Resort L.L.C. and the City of San Leandro on a 6-1 <br />vote at their meeting of March 2, 1998. <br />On April 1, 1998, Ann Duncan representing the Hotel Employees, Restaurant Employees and <br />Bartenders Union, Local 2850, AFL-CIO submitted to the City Clerk, 19 sections of petitions <br />consisting of approximately 5,700 signatures, for a referendum on Resolution No. 98-26. <br />After reviewing the petitions for completeness, they were transported to the County Registrar of <br />Voters for signature verification on April 3, 1998. Pursuant to Elections Code 9114, the City <br />Clerk has 30 days from the date of the filing of the petitions, excluding Saturdays, Sundays, and <br />holidays, to examine the petition, and to verify that the requisite number of voters signed the <br />petition. <br />53 <br />
