CALIFORNIA DEPARTMENT OF FISH AND GAME
CERTIFICATE OF FEE EXEMPTION
De Minimis Impact Finding
Project Title/Location Name and Address of Project Proponent (include county): A-98-3; to amend
the Zoning Code to include requirements for the siting of telecommunication facilities such as,
telecommunication towers, antennae and alternative tower structures
Project Description: The proposal is to amend the City of San Leandro Zoning Code to include general
guidelines for the siting of telecommunication facilities such as, telecommunication towers, antennae and
alternative tower structures. The proposed telecommunications ordinance will seek to reduce the total
number of towers located throughout the City, encourage service providers to minimize adverse visual
impacts, and set standards which the City may approve the placement of telecommunications facilities.
Findings of Exemption:
1. The City Council approved the proposal to amend the Zoning Code to include requirements for the
siting of telecommunication facilities such as, telecommunication towers, antennae and alternative
tower structures.
2. An initial study has been conducted to evaluate potential adverse environmental impacts.
3. The City Council finds and determines that, when considering the record as a whole, there is no
evidence before the City that the proposed Code amendment will have potential for an adverse effect on
the wildlife resources or the habitat on which wildlife depends.
4. The City Council, based on the substantial evidence incorporated on the initial study, negative
declaration, and staff reports, rebuts to presumption of adverse effect provided in Section 753.5(d) of
Title 14, California Code of Regulations.
Certification:
I hereby certify that the lead agency has made the above findings of fact and that based upon the
initial study and hearing record the project will not individually or cumulatively have an adverse effect on
wildlife resources, as defined in Section 711.2 of the Fish and Game Code.
Elmer Penaranda
Title: Assistant Planner
Lead Agency: City of San Leandro
Date: October 16, 1998
FG 753.5 (5/91)
Section 711.4, Fish and Game Code
G-.Wme6pcia-98-03.exm
