Though <br />there is great reluctance to surrender or to compromise what they feel is their right to full access <br />to Harold Avenue, I can put forward what represents mutual agreement on a compromise as <br />follows: <br />"To curtail night time noises, St. Moritz Management will maintain both the pedestrian gate and <br />the vehicle exit gate in a closed and non -operative position during the hours of 10:00 p.m. to 5:00 <br />a.m. Respecting the Fire Department Recommendations, the spike system, presently in place, will <br />be removed. <br />These measures will be undertaken provided: <br />A. That there is acknowledgment that by agreeing to this compromise, St. Moritz Tenants, as <br />San Leandro Residents, do not abdicate their right of access to or use of Harold Avenue <br />as a public street. <br />B. This action will bring to a conclusion this matter without further review conditions." <br />As I knew, this had become a very explosive issue amongst the tenants and there was no <br />compromising at first but, motivated by my desire to keep a lid on things, I pressed forward and <br />prevailed. However, the tenants insisted upon doing nothing to lessen their rights and upon this <br />being the end of the issue. Hence the stipulations "A" and "B" above.
