Caughell, Administrative Assist t <br />SUBJECT: RESOLUTION OF NECESSITY DETERMINING THAT THE PUBLIC <br />INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN <br />EASEMENTS AND DIRECTING THE FILING OF EMINENT DOMAIN <br />PROCEEDINGS - STORM DRAIN - MERCED STREET TO WILLIAMS <br />STREET PROJECT <br />SUMMARY AND RECOMMENDATION <br />A Public Hearing concerning the acquisition of public utility easements for the storm drain, Merced Street to <br />Williams Street Project, has been scheduled for the February 18, 1997 City Council meeting. Upon the <br />conculustion of the Public Hearing, staff recommends the approval of a Resolution of Necessity to authorize the <br />City Attorney to file eminent domain legal action against two property owners: 1) Wayne R. Hilf, owner of <br />property at 1777 Abrams Court and 2) Thomas K. McManus, Jr. and Janet Anne McManus, owners of <br />property at 2000 Merced Street. <br />BACKGROUND <br />For many years, there has been a storm water drainage problem on the south side of Williams Street in the <br />vicinity of the Golden Gate Seafood, Inc. (GGS) property at 1815 Williams Street. Because of the topography <br />in this area, there is storm water ponding during the winter season in front of GGS on Williams Street and along <br />their westerly property line. <br />To correct this drainage problem in the public right-of-way and on GGS's property, the City has entered into a <br />cost -sharing agreement with GGS to construct a 24" storm drain pipe. As shown on Exhibit A, the storm drain <br />pipe will run from Williams Street, pass through GGS's property and two other properties (1777 Abrams Court <br />and 2000 Merced Street) and finally be connected to an existing storm drain pipe on Merced Street. As part of <br />our agreement with GGS, the City will receive an easement for the storm drain construction on their property at <br />no cost. The City, however, needs to acquire permanent easements and temporary constructions at two <br />5 <br />
