CALiruKNIA DEPARTMENT'OF FISH AND GAME CERTIFICATE OF FEE EXEMPTION De Minimis Impact Finding Project Title/Location Name and Address of Project Proponent (include county): A-97-1 & PD-97-1; to rezone 91 Durant Avenue from NA-2 North Area District to RS(PD) Residential Single -Family, Planned Development District; and Planned Development to construct four new , detached single family homes; Durant Park Development Limited Liability Company c/o Richard Weinstein, 3661 Grand Avenue, #106, Oakland, California, 94610; Alameda County. Project Description: The proposed project is to divide the property into four separate parcels, two of which will be flag -shaped lots, with adjacent driveways up the middle of the property to the rear two. Each parcel will have a single family house constructed on it. The homes will have three bedrooms, two bathrooms and attached two -car garages. The exterior will be stucco walls and composition shingle roofs. The driveways will be constructed of concrete and decorative concrete. Findings of Exemption: 1. The City Council approved the proposal to rezone the property to a residential base district and to construct four detached single-family homes on the subject property. 2. An initial study has been conducted to evaluate potential adverse environmental impacts. 3. The City Council finds and determines that, when considering the record as a whole, there is no evidence before the City that the proposed project will have potential for an adverse effect on the wildlife resources or the habitat on which wildlife depends. 4. The City Council, based on the substantial evidence incorporated on the initial study, negative declaration, and staff reports, rebuts to presumption of adverse effect provided in Section 753.5(d) of Title 14, California Code of Regulations. Certification: I hereby certify that the lead agency has made the above findings of fact and that based upon the initial study and hearing record the project will not individually or cumulatively have an adverse effect on wildlife resources, as defined in Section 711.2 of the Fish and Game Code.
