(b) Contractor or its qualified agents or employees, in sufficient number to <br />handle golf course and related activities, shall be on duty at the golf course and Pro <br />Shop each and every golfing day during the period of this agreement. Owner <br />expressly reserves the right to specify the hours during which said facilities shall be <br />kept open for business and the services thereof made available to the public. <br />(c) Contractor will be subject to a mandatory injunction to compel the <br />specific performance of the provisions of this Agreement. <br />(d) Contractor shall meet with Owner at Owner's request to review <br />operation of the Pro Shop. Contractor will make reasonable changes to such <br />operation as requested by Owner. <br />9. Personnel. Personnel employed by Contractor will be deemed <br />employees of Contractor and will not for any purpose be considered employees or <br />agents of Owner. Contractor assumes full responsibility for the actions of such <br />personnel while performing services pursuant to this Agreement, and shall be solely <br />responsible for their supervision, daily direction and control, payment of salary <br />(including withholding and income taxes, unemployment insurance, worker's <br />compensation, and social security) and the like, as required by law. All employees of <br />Contractor shall wear insignia so identifying them. <br />10. Nondiscrimination. <br />(a) Contractor and its employees shall not discriminate because of race, <br />religion, color, sex, marital status, ancestry or national origin against any person by <br />refusing to furnish such person any accommodation, facility, service or privilege <br />offered in accordance with the provision of section 1 hereof, nor shall Contractor or <br />his employees publicize the facilities, services or privileges in any manner that would <br />directly or inferentially reflect upon or question the acceptability of the patronage of <br />any person because of race, religion, color, sex, marital status, ancestry, or national <br />origin. <br />(b) In the performance of this Agreement, Contractor shall not discriminate <br />against any employee or applicable for employment because of race, color, religion, <br />sex, ancestry or national origin. Contractor shall take affirmative action to insure <br />that applicants are employed and that employees are treated during employment <br />without regard to their race, color, religion, sex, ancestry or national origin. Such <br />action shall include, but not be limited to, the following: employment, upgrading, <br />demotion or transfer; recruitment or recruitment advertising; layoff or termination; <br />EXHIBIT C - PERSONAL SERVICES AGREEMENT PAGE 3 <br />REV 6/27/97 <br />
