Rockett, Public Works Services Director <br />EBDA / LAVWMA agreement for LAVWMA's Use of Deep Water Sewage <br />Effluent Outfall <br />SUMMARY AND RECOMMENDATION <br />After more than ten years of negotiation, the Livermore-Amador Valley Water Management <br />Agency (LAVWMA) is in the final stages of approving an agreement with East Bay Dischargers <br />Authority's (EBDA) for use of EBDA's deep water sewage effluent outfall. San Leandro is a <br />member agency of the East Bay Dischargers Authority. The attorneys for EBDA and LAVWMA <br />have prepared a draft agreement for review by all agencies. The City Council is requested to <br />consider mitigations for construction of the LAVWMA pipeline in Lewelling Blvd. and <br />authorize its EBDA representative, Councilmember Galvan, approve the final agreement if it is <br />in substantial compliance with the attached draft agreement. <br />BACKGROUND <br />East Bay Dischargers Authority (EBDA) is a joint powers agency created by Union Sanitary <br />District, Oro Loma Sanitary District, Castro Valley Sanitary District, City of Hayward and the <br />City of San Leandro to construct and operate the transmission line and deep water outfall for the <br />combined sewer effluent of the member agencies. The Livermore-Amador Valley Water <br />Management Agency (LAVWMA) is also a joint powers agency composed of the Cities of <br />Livermore and Pleasanton and the Dublin -San Ramon Services District. During construction of <br />the deep water outfall for EBDA, LAVWMA paid construction costs to increase the capacity by <br />19.72 million gallons per day (MGD). This 19.72 MGD capacity is owned by LAVWMA but is <br />not adequate for the projected increased flows resulting from development within its service area. <br />LAVWMA has processed a conceptual agreement among its member agencies which would <br />allow an additional 20.2 MGD of interuptible capacity to be discharged through EBDA's deep <br />205 <br />
