Jermanis Manager Subject: EBDA (East Bay Dischargers Authority)/LAVWMA (Livermore-Amador Valley Water Management Agency) Agreement for LAVWMA's Use of Deep Water Sewage Effluent Outfall SUNS IARY AND RECONIlVIENDATION At the October 20, 1997 City Council session, Council established an ad hoc sub -committee consisting of Council Members Glaze, Polvorosa and Galvan to meet and discuss the EBDA/LAVWMA Agreement and to report back to City Council with recommendation. Council Sub -committee has met and recommends the City Council direct: A). Council Member Galvan to vote as an EBDA Board Member to approve an agreement between LAVWMA and EBDA for the use of EBDA's deep water sewage effluent outfall if the agreement is in substantial conformance with the draft agreement attached to the October 20 Council report, and B). the City Manager transmit the attached letter to LAVWMA. • .I Juf On October 20, 1997, the City Council appointed a sub -committee consisting Council Members Glaze, Polvorosa and Galvan. The sub -committee met on October 21, 1997 with City Attorney and consultant, Robert Taylor, on the EBDA/LAVWMA issue. The Sub -committee agreed that Council Member Galvan should vote yes on an agreement between EBDA and LAVWMA if that agreement, as presented at the EBDA meeting, is in substantial compliance with the agreement presented to City Council on October 20, 1997. The Sub -committee also agreed that a letter should be sent by the City Manager to LAVWMA outlining the conditions the City will consider with the issuance of any encroachment permit for construction of the LAVWMA project within San Leandro City Limits and potential mitigation measures to the LAVWMA Environmental Report.
