San Leandro Council Member Handbook | 20212022 <br />19 | Page <br /> <br /> <br />• When two-thirds of the members present (or all members if less than five members <br />present) determine there is a need for immediate action and the need to take action <br />1“came to the attention of the council after the agenda being posted.”. <br />• When an item appeared on the agenda of and was continued from, a meeting held not <br />more than five days earlier. <br /> <br />POSTING OF AGENDA <br />The Clerk’s Office must post a copy of the agenda on the notice board outside the East 14th Street <br />main entrance to the Civic Center, not less than 72 hours before each regular meeting, and not <br />less than 24 hours before each special meeting to be held by the City Council. Notices may also <br />be included on public access or electronic media, such as the City’s website and cable television. <br />The agenda shall also be available to the general public by noon on Friday before the City Council <br />Meeting scheduled. Agendas are also available by email by subscription from the City website, or <br />by mail when self-addressed postage paid envelopes are provided. <br />DISTRIBUTION OF AGENDA <br />If practicable, the agenda and agenda item report packet shall be provided to Council Members <br />the Tuesday, preceding the Monday meeting to which it pertains. Council Members are asked to <br />advise the City Clerk’s Office whether they desire agenda packets to be delivered electronically <br />or to their City Hall mailbox. Holiday schedules may vary. <br /> <br />PUBLIC HEARINGS <br />Public Hearings precede Public Comments. Anyone wishing to speak regarding a Public Hearing <br />item may do so at that time. The order of business for public hearings is as follows: <br />1. Staff presentation <br />2. Applicant/Appellant – 10 minutes <br />3. City Council Questions/Clarifications <br />4. Public Comments – 5 2 minutes per speaker, subject to adjustment by <br />the Mayor <br />5. Applicant/Appellant Rebuttal – 5 minutes <br />6. City Council Comments/Questions/Action <br /> <br />Council Members should not speak to an issue until the public hearing has been closed. If a <br />Council Member has met with a proponent/developer or opponent of the subject hearing, he/she <br />should acknowledge such meeting before the opening of the hearing at the Council meeting. <br />Once a hearing is closed, it is inappropriate for the public to speak except to answer an inquiry <br />of Council Members addressed through the Chair. <br /> <br />1 This exception does not apply in situations where the Council or staff knew about the need to take immediate <br />action before the agenda was posted. Forgetting a deadline does not count as a unexpected need. <br /> <br />
