San Leandro Council Member Handbook | 20212022 <br />33 | Page <br /> <br /> <br /> <br />SECTION VI COMMUNICATIONS <br />MEMBERS OF THE PUBLIC ADDRESSING THE COUNCIL AT MEETINGS <br />Any citizen may address the Council on any business concerning <br />him/her, or affecting his/her interests; however, preference will <br />be given to those who have first presented matters in the form <br />of written communication, or who have notified the Presiding <br />Officer of their desire to speak. <br /> <br />Any member of the public who wants to address the Council <br />shall complete a “speaker card” and hand it to the City Clerk. The <br />City Clerk will advise the Presiding Officer. The Presiding Officer <br />will announce the names from the speaker cards. Once the <br />individual’s name is called, that individual should proceed to <br />theto the podium and wait to be recognized by the Presiding <br />Officer. <br />After being recognized, the individual will speak directly into the microphone and for the record, <br />shall state his/her name. Members of the public may submit speaker cards to address items listed <br />under Public Hearings, Public Comments, Consent Calendar or Action Items. Speakers will <br />address the City Council after the staff presentation has been completed. <br /> <br />The Presiding Officer shall have the power to change the order of business during a City Council <br />Meeting if the number of persons in attendance warrants such a change. <br /> <br />Under the provisions of the Brown Act, the City Council is prohibited from discussing or taking <br />action on an item not appearing on its posted agenda. Therefore, any issue raised under the <br />Public Comments section of the agenda will be referred to staff for a decision about placing it on <br />a future agenda for discussion, action, or report. <br /> <br />A. TIME LIMITATION <br />Any member of the public who speaks before the Council shall limit his/her address to <br />five two (52) minutes during Public Hearings. Members of the public who address the <br />Council during Public Comments, Consent Calendar, or Action Items shall be limited to <br />three two (32) minutes per agenda item, and a maximum of five (5) minutes for all <br />Consent Calendar items, subject to the discretion of the Chair. <br /> <br />B. APPLICANTS AND/OR APPELLANTS – PUBLIC HEARINGS <br />Any applicant and/or appellant who speaks before the City Council shall limit their address <br />to ten (10) minutes. This time limit will not be applied to speakers to whom constitutional <br />due process applies. The City Attorney shall advise the City Council in this regard. <br />Applicants and/or appellants shall be allowed five (5) minutes for rebuttal following public <br />comments and before City Council comments and questions. <br /> <br />
