Seto, Assistant City Attorney <br />RE: Firearm Regulations <br />DATE: August 15, 1996 <br />PAGE: 5 <br />goods for retailers and wholesalers of firearms and ammunition. <br />Questions: Questions were raised about: (a) targeting funds raised for specific <br />uses; (b) necessary votes; (c) the effect of Jarvis initiative on the <br />November ballot. <br />(a) Presently, the funds would be deposited into the General <br />Fund for general governmental purposes. By resolution or <br />through the budget process, the Council could decide to direct <br />these revenues to specific programs. <br />If the Council desires to have the funds immediately placed into a <br />specific fund for a specific purpose, it would be considered a <br />special tax. Special taxes require a two-thirds vote of the <br />qualified electors.' <br />(b) Under the proposed ordinance, only a majority vote of the <br />Council would be needed to impose the business license fee. If <br />the Council desires to have the funds immediately placed into a <br />special fund, a two-thirds vote of the electors is needed. <br />(c) The Jarvis Group's initiative, The Right to Vote on Taxes, <br />may implicate this and other taxes recently passed by the <br />Council.
