TO: Honorable Mayor and City Council Members
FROM: Steven R. Meyers, City Attorney
Larissa M. Seto, Assistant City Attorney
RE: Firearm Regulations
DATE: August 15, 1996
PAGE: 5
goods for retailers and wholesalers of firearms and ammunition.
Questions: Questions were raised about: (a) targeting funds raised for specific
uses; (b) necessary votes; (c) the effect of Jarvis initiative on the
November ballot.
(a) Presently, the funds would be deposited into the General
Fund for general governmental purposes. By resolution or
through the budget process, the Council could decide to direct
these revenues to specific programs.
If the Council desires to have the funds immediately placed into a
specific fund for a specific purpose, it would be considered a
special tax. Special taxes require a two-thirds vote of the
qualified electors.'
(b) Under the proposed ordinance, only a majority vote of the
Council would be needed to impose the business license fee. If
the Council desires to have the funds immediately placed into a
special fund, a two-thirds vote of the electors is needed.
(c) The Jarvis Group's initiative, The Right to Vote on Taxes,
may implicate this and other taxes recently passed by the
Council. A determination of the possible impact is uncertain at
this time.
' See Cal. Const. Article XIII A, section 4; and City and County of San Francisco
v. Farrell (1982) 184 Cal.Rptr. 713.
103
